This Privacy Policy governs the manner in which LeadPoint, Inc. (hereafter also referred to as “LeadPoint,” “we” and “us”) collects, uses, maintains and discloses information collected from users (each, a “User”) of the HOMEKICK mobile application (hereinafter “app” or “application”), HOMEKICK website at homekick.com (hereinafter “site” or “website”), the HOMEKICK Facebook page or application, HOMEKICK’s Twitter account, any other affiliate websites related to HOMEKICK (together, collectively the “Service”). By accessing the Service, you acknowledge and agree to this Privacy Policy and also agree to the Terms of Use of the Service located at: www.HomeKick.com/terms

Please be further advised that, when you provide information (including Personal Information as defined below) to one of our Leadpoint websites (including Homekick.com, Leadpoint.com and Moneytips.com), we may share that information with other Leadpoint websites.

We reserve the right to make any changes to our privacy policy at any time, notice of which may be posted on this privacy page. Users must refer back to our privacy policy to read any changes in our privacy policy.

Information Collection

While using this Service, you may provide us with personally identifiable information. This refers to information about you that can be used to contact or identify you, and information on your use of and activities at HOMEKICK (“Personal Information”). Personal Information that we collect may include, but is not limited to, your name, primary residential address, secondary or other non-primary residential address, and email address. Your credit card information is never stored on our server. Personal Information may also include (i) property information about your residences including, but not limited to, number of bedrooms, bathrooms, garage size, basement, pool, and other related information; (ii) regularly scheduled services such as, but not limited to, gardening service, pool service, housekeeping, and pest control; (iii) your bid request from service professionals and any associated transaction, chat messages between you and the professional; and (iv) your preferences and interests expressed in the course of using the Service or other information gathered from your Facebook, Twitter, or other social media profiles.

For Users who are service professionals, we may collect the following: (i) personal information including, but not limited to, your full name and phone number; (ii) business information including, but not limited to, your business name, email address, web URL, service categories served, general description of your business, hours of operation, service specialties, geographic areas served, any consumer reviews about your business, and any ratings from consumers about your business; (iii) new business leads including, but not limited to, requested quotes, awarded jobs, quotes sent to customers, ads or promotions offered to consumers; and (iv) billing information including, but not limited to, any HOMEKICK subscriptions (free or premium) or credit card information for monthly or annual premiums.

Other information that may be collected includes user-generated, either consumer or professional, content such as, but not limited to, ratings, reviews, photographs, or videos

When you use HOMEKICK’s site or apps, our servers automatically record information that your browser sends whenever you visit our Service. This information may include, but is not limited to, your computer’s Internet Protocol address (IP address), browser type, and the web page you were visiting before you came to HOMEKICK. We use “cookies” to collect information. A cookie is a small data file that is transferred to your computer’s hard disk to facilitate your computer’s future access to this information. We use cookies to better understand how our users interact with the site, to monitor usage and how traffic arrives at our site and to improve the functionality of the site. User may choose to set their web browser or mobile device to refuse cookies, or to alert you when cookies are being sent. If you choose not to accept cookies, please note that some parts of the Service may not function properly.

Do Not Track Signals from Web Browsers – The Service is not presently configured to support Do Not Track (“DNT”) signals from web browsers.

How We Use Personal Information

Personal Information is used to provide and improve our website and services; to better understand your needs and interests; to personalize your experience; to provide or offer updates and product announcements; and to provide you with further information and offers from us that we believe you may find useful or interesting, including newsletters, marketing or promotional materials and other information on services and products offered by us or third parties that are authorized by us. The foregoing includes sharing Personal Information of Users with Service Professionals to the extent required to fulfill any transaction proposed between them.

Information is gathered to monitor and analyze use of HOMEKICK and our services, for technical administration, to increase our site’s functionality and user-friendliness, to better tailor it to your needs, to generate and derive useful data and information concerning the interests, characteristics and website use behavior of our users.

We may also use the Personal Information to contact you to further discuss interest in Leadpoint, the services that we provide through Leadpoint websites, and to send information regarding Leadpoint or partners, such as promotions and events. You may be invited to receive an email newsletter or other correspondence by providing an email address. Your email address and any Personal Information will not be distributed or shared with third parties unless it is to transact such business as you have contracted us to do, to comply with any legal processes and/or law enforcement requests, or in order to conduct any business as we, in our sole subjective discretion, deem reasonable. We may also email (or send via other methods) information regarding updates to the Service or Leadpoint, and may send a newsletter, or other correspondence. You will have an opportunity to unsubscribe to any emails or newsletters by clicking on the link at the bottom of the communication. Even if you are removed from any such list and you continue to use the Service, you will continue to receive email correspondence from Leadpoint related to the Service. Any opt-out by you is not deemed valid until processed by Leadpoint. It is your obligation to verify that you have been opted-out. Leadpoint shall not be liable for problems with the opt-out procedures.

Disclosure of User Information to Third Parties

In addition to the use of information described above, HOMEKICK reserves the right to disclose information (including Personal Information) provided by Users (including Service Professionals) as follows:

  • Service Providers, Business Partners and Others.

    HOMEKICK does not control the privacy policies of third parties, and you are subject to the privacy policies of those third parties where applicable. HOMEKICK is not responsible for the privacy or security practices of other websites on the Internet, even those linked to or from the HOMEKICK site. We encourage you to ask questions before you disclose your personal information to others.

    We may employ third party companies and individuals to facilitate our service, to provide service on our behalf, to perform website related services (including but not limited to maintenance services, database management, web analytics and improvement of HOMEKICK’s features) or to assist us in analyzing how our website and service are used and can be improved. These third parties may have access to your Personal Information only for purposes of performing these tasks on our behalf.

  • Compliance with Laws and Law Enforcement.

    HOMEKICK must cooperate with government and law enforcement officials and private parties to enforce and comply with the law. In the event of a claim and/or legal process (including but not limited to subpoenas), to protect the property and rights of HOMEKICK or a third party, to protect the safety of the public or any person, or to prevent or stop any activity we may consider to pose a risk of being illegal, unethical, inappropriate or legally actionable, we reserve the right to disclose any information about you to government or law enforcement officials or private parties as we in our sole discretion find necessary or appropriate.

  • Business Transfers

    In the event of a bankruptcy, merger, acquisition, reorganization or sale of assets, HOMEKICK may sell, transfer or otherwise share some or all of its assets, and your Personal Information may be transferred as part of that transaction. To the maximum extent allowable by law, the Privacy Policy will apply to the User information as transferred to the successor entity. However, User information submitted after a transfer to a successor entity may be subject to a new privacy policy adopted by the successor entity.

Security

HOMEKICK takes the security of your Personal Information seriously. We will employ reasonable measures designed to protect your information from unauthorized access and unsolicited contact from third party groups. To that end, all sensitive personal information (credit card data) is transmitted through secure networks supported by high-grade 256-bit encryption. Credit card numbers are not stored or held on our servers.

Our Policy Toward Children

HOMEKICK is not directed to nor is it intended for children under 18. We do not knowingly collect personally identifiable information (or any information at all) from any persons under 18 years old. If we become aware that a child has provided us with Personal Information, we will delete such information from our files. Users of HOMEKICK accept responsibility of ensuring that children are not accessing or using our website.

For Users Outside of the United States Only

The Service is hosted on servers located in the United States. If you are a user accessing the Service from the European Union, Australia, Asia, or any other region with laws or regulations governing personal data collection, use, and disclosure, that differ from United States laws, you are transferring your personal data to the United States which may not have the same data protection laws as such other regions. By providing user information through the Service you are consenting to the transfer of your information to the United States for processing and maintenance in accordance with this Privacy Policy and the Terms of Use. You are also consenting to the application of United States law in all matters concerning the Service and any services offered or provided therefrom.

Advertising

Ads appearing on our website may be delivered to Users by advertising partners, who may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement to compile non personal identification information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This privacy policy does not cover the use of cookies by any advertisers.

Legal Disclaimer

This Service operates "AS-IS" and "AS-AVAILABLE," without warranties of any other kind. We are not responsible for events beyond our direct control. This Privacy Policy is governed by the laws of the State of California, excluding conflicts of law principles. Any legal actions against us arising out of or related to the Service are subject to the Resolution of Dispute provisions in the Terms of Use.
